  1. First and foremost, contact your local state nursing home abuse hotline. It’s a confidential 800 number usually. You can call in. Let them know your concerns that your loved one has fallen. They will then open up an investigation and find out what occurred or at least interview the staff members that were involved in your loved one’s care. It is not determinative as to whether or not there was negligence on behalf of the nursing home necessarily, but it’s very helpful in terms of gathering that information.
  2. Second, you must then also talk with an experienced nursing home abuse and neglect attorney so that they can analyze the records and the findings of the state and counsel you on that.

We know that the consequences of an elderly person falling in a nursing home can be devastating. In fact, the National Institute of Health has done studies on hip fractures in the elderly in nursing homes and found that they have a 30% death rate in the next 12 months after a fracture.
